On 4 January 2023, the Romanian Parliament promulgated the Law on the modification and completion of Article 6 of the Law on Physical Education and Sport no. 69\/2000, a moment of great importance for the sports and educational community. The law provides for free access for all children and young people to the outdoor sports grounds and fields of educational establishments that are part of the public domain and administered by local councils, as well as for young people over the age of 18 attending secondary or vocational education.<\/span><\/p>\n

 <\/p>\n

This legislative initiative has been the subject of discussions in the Romanian Parliament over the years, but only received the green light through promulgation in 2023. Although it seems a necessary and welcome change, the issues that led to the delay in the adoption of this bill should be taken into consideration in order to understand why free access to sports facilities was not allowed earlier.<\/span><\/p>\n

 <\/p>\n

An important explanation can be found in history and sociology. In other European countries, such as Denmark or the Netherlands, there is a strong trust in citizens and the belief that they will use public spaces, including parks and sports grounds, responsibly and civically. These countries also have adequate security and protection and cleanliness of parks is a priority. In addition, in emergencies, medical services and police are quick to respond.<\/span><\/p>\n

 <\/p>\n

In Romania, however, the situation is a little different. Some key factors have prevented free access to state sports facilities. In many cases, educational establishments in Romania, especially those in poor communities, do not have the financial resources to hire security guards or private security services. This has led to the closure of schoolyard gates to prevent risk and inconvenience.<\/span><\/p>\n

 <\/p>\n

However, in Giurgiu county there was in the past this practice of playing sports in the school yard, even after school hours. From my own experience, these activities created communities with pupils from different schools who had common passions and sports activities. However, as a result, it was preferred to maintain a broken regulation, which led to the closure of schoolyards and sports fields.<\/span><\/p>\n

 <\/p>\n

Also, from a legal point of view, there are questions of responsibility and liability in the event of undesirable events that may occur on sports grounds open to the public. For example, how are serious conflicts or accidents dealt with? Who bears the responsibility and who bears the damages in case of unfortunate incidents?<\/span><\/p>\n

 <\/p>\n

In addition, the lack of clarity in the text of the law has created uncertainty and differing interpretations among school and local administrations. Although by May 2023, educational establishments were required to make sports facilities and pitches available to local communities, the lack of a well-defined framework on the implementation of this law has led to reluctance on the part of many educational establishments to allow free access to sports pitches.<\/span><\/p>\n

For example, from field research today there are schools in Giurgiu that have started this process, and from the statements of pupils it appears that they enjoy their time together. Thus, understanding the motivations and difficulties faced by the authorities in implementing this law is essential to ensure consistent and responsible implementation. It is important to have adequate financial support and resources to secure and monitor sports facilities open to the public so that free access can be a reality in all schools across the country.\u00a0<\/span><\/p>\n

 <\/p>\n

Through a collaborative effort and legislative clarification these challenges can be overcome and physical education and sport can be effectively promoted among young people in Romania.<\/span><\/p>\n
