When we talk about civic engagement, it seems to me that example has great power for other people, inspiring them to follow a similar path. Based on this premise, which I really believe in, I will tell you today about my opportunity to be part of a group of students who took action to change the situation regarding rail discounts, in the sense of making them free again.<\/span><\/p>\n

 <\/p>\n

For context, on 6 January 2017, GEO 2\/2017 came into force, which established free rail transport for students, amending the Education Act to this effect. Basically, from that moment on students could travel for free by train, which was a great opportunity for many, making travel much easier. I must admit, I was very happy about this opportunity, because I could travel and discover Romania for free.<\/span><\/p>\n

 <\/p>\n

However, 4 years later, on 18 February 2021, the Government adopted GEO no. 8\/2021, amending the Education Law in order to abolish free rail transport for students, followed by GD no. 341\/2021, which implemented the ordinance.\u00a0 The gratuity was replaced by a 50% discount, clearly creating disappointment among students. I believe that the disappointment was caused more by the way in which the gratuity was removed than by the gratuity itself. I say this because the measure was taken at short notice, through an unjustified emergency ordinance and without any significant positive budgetary impact (40 million euros\/year).<\/span><\/p>\n

Observing these facts, a group of about 14 people started the #GratuitateSpreFacultate initiative, made up of several fellow law students, coordinated by Andrei-Mihai T\u0103nase. We all knew that the ordinance had to go to the Constitutional Court to be declared unconstitutional, so we had to come up with a plan to get there.\u00a0<\/span><\/p>\n

 <\/p>\n

After having a call where we put together the puzzle pieces and possibilities, things, although challenging, looked simple on paper. Each filed an action with the Court of Appeal in the district of each person’s residence seeking the annulment of the aforementioned HG 341\/2021. Within this process, each one was going to ask the court to refer to the Constitutional Court an exception concerning GEO 8\/2021 until this annulment was resolved. Thus if the exception was admitted, our request before the court would automatically be admitted, because the Government Decision would implement an unconstitutional ordinance.\u00a0<\/span><\/p>\n
